SU MART Terms & Conditions

1. General

The Terms & Conditions apply to the sale of goods and services from www.sumart.no to consumers. They, together with your order and order confirmation, will constitute an overall contractual basis for the purchase.

If you use www.sumart.no and create an account, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use www.sumart.no only with involvement of a parent or guardian.

Consumer purchases are regulated by the Consumer Purchases Act, the Right of Withdrawal Act, the Marketing Act, the Personal Data Act, the E-Commerce Act and the Credit Purchases Act. You can find these laws at https://lovdata.no/.

3. Price and Payment

The prices, which are stated in the online store, include VAT.

Information about the total costs the buyer must pay, including all taxes (VAT and the like) and delivery costs (shipping, etc.) as well as specification of the individual items in the total price, is given in the ordering solution before ordering.

The purchase can, at your own choice, be settled via bank or credit card, WeChat Pay, Alipay or Vipps.

4. Delivery

Delivery of the products takes place in the manner, at the place and at the time stated on the order confirmation. We are responsible for the products until they are taken over by you, i.e. when you have received the products.

The delivery method can be self-pickup or delivery by us.

For self-pickup, the picking-up time will be agreed between SU MART and customers. If frozen products included in the order, the products will be packed within 2 hours before the customers coming to pick up.

For delivery by us (via shipment agent), delivery time in Trondheim area is normally within 3 days as long as the products in stock. If the products are not in stock, the delivery time will be agreed between SU MART and customers but generally will be within 3 days after the products arrived in stock. If frozen food included in the order, the delivery will happen within 2 hours after packing.

SU MART currently does not provide delivery for the customers outside Trondheim area.

All delivery times stated by us must be considered as indicative. When time is stated in the number of days, it is meant weekdays. We reserve the right to deviate and or change the stated delivery time without further notice.

Any price changes that occur after confirmation of an order that are not due to errors will not have retroactive effect.

If there have been significant typing or printing errors, in advertisements and the like, and / or in the online store, that is greater than 15% of the normal retail price, SU MART may unilaterally change, delete or reject orders. This applies even if the customer has received an order confirmation or similar. However, such errors must be corrected within a reasonable time after the error is discovered.

5. Right of withdrawal

SU MART complies with the rules in force at any given time in the Right of Withdrawal Act, which gives a general right to a 14-day right of withdrawal from the delivery date to regret your purchase. Note that there are special provisions in the Right of Withdrawal Act related to fixed-term benefits and goods that deteriorate rapidly, such as certain food and beverages, where the general withdrawal period does not apply (Ihht. til §22 i Angrerettloven [the Right of Withdrawal Act]):

· Delivery of goods that deteriorate or expire quickly,

· Delivery of sealed goods which for reasons of health or hygiene are not suitable for return, and where the seal has been broken after delivery,

· Services those are urgent to have performed where the consumer explicitly asks the trader (SU MART) to visit the consumer.

· Transport of goods where a specific date or time limit is set for the performance of such services.

· The right of withdrawal does not apply to users who act on behalf of a company or organization.

If you wish to use the right of withdrawal, you must, before the expiry of the withdrawal period, send us a clear message in the manner specified. You must state your name, address and other relevant information in the message, such as order reference, invoice number and the name of the product. If you use your right of withdrawal, you will pay for the return shipping costs and are responsible for the condition of the product after you have received the product and during the return shipment. The product must be returned within 14 days from the date we were notified that you are using the right of withdrawal. The product must be sent well packaged, in good condition and in a packaging that can withstand the mail.

If you use the right of withdrawal, you will be refunded the amount you paid for the product in the order that was placed.


6. Defect in the item - the buyer's rights and complaint deadline

SU MART complies to the Consumer Purchases Act (Forbrukerkjøpsloven) of 21 June no. 34 2002 for general rules regarding complaints. Our guarantees do not imply any restrictions in the complaint deadline for goods under the Consumer Purchases Act. However, we have a customer promise that extends even further at some points:

When you receive the goods, you should as soon as you have the opportunity to see if the delivery is in accordance with the order confirmation and if the products have been damaged during transport. If there is an error or defect in an item upon delivery, you will have the opportunity to either have a new copy of the same item delivered at a later date, or have the payment to the same account that paid for the order.

The shelf life guarantee does not apply as long as the item is discounted or sold in connection with the promotion.

The customer is obliged to check that the goods and delivery are in accordance with the order confirmation and whether the products have been damaged during transport.

Cancellation and complaints can be reported to sumart.info@gmail.no.

If there is a defect in the order, you must within a reasonable time after you discovered or should have discovered the defect (No later than 7 days after delivery), notify us of this. The absolute last deadline for advertising is two years after you took over the thing. If the thing or parts of it in normal use are intended to last significantly longer, the deadline for advertising is five years.

Refunds will be made within 14 days after we have been notified.

7. Conflict resolution

The parties shall endeavor to resolve any disputes amicably. The buyer can contact the Consumer Council to get assistance in a possible dispute with the seller. If an amicable solution is not reached after mediation in the Consumer Council, the parties may request in writing that the Consumer Council submit the dispute to the Consumer Disputes Committee. Decisions by the Consumer Disputes Committee are final four weeks after service. Before the decision is final, the parties may, by submitting a summons to the Consumer Disputes Committee, bring the decision before the district court.
